FTC Guidelines

United Kingdom – CMA & ASA (CAP Code)

  • Clearly disclose all paid promotions, affiliate links, and gifted products.
  • Use clear and upfront wording such as “Ad”, “Advert”, “Advertisement”, “Paid Partnership”, or “Affiliate Link”.
  • Disclosures must be obvious (not hidden in hashtags or at the bottom of posts).
  • Publishers using affiliate links must clearly state they may earn a commission.

European Union – European Commission Guidance

  • Influencers must disclose commercial content clearly.
  • Labels such as “Advertisement” or “Sponsored” should be used.
  • Hidden or misleading endorsements are prohibited.

United States – FTC (Federal Trade Commission)

  • Influencers must disclose any “material connection” (payments, gifts, affiliate links).
  • Disclosures must be clear and conspicuous – not hidden in hashtags.
  • Examples: “Ad” or “Sponsored” at the beginning of a post. “I earn a commission if you buy through this link.”

Best Practices (Applies Everywhere)

  • Always disclose when content is an advertisement, affiliate promotion, or sponsored collaboration.
  • Place disclosures clearly at the start of a post, video, or caption.
  • Use simple language – avoid legal jargon.
  • Make sure disclosures are visible on all platforms (social media, blogs, emails).
  • If in doubt, be more transparent – honesty builds trust.
